Regardless, it's illegal to tape someone when they don't know it. And, she could argue that she didn't know she was being taped.

Depends on the break-up, if it was all done in order I'd get rid of it, but in the unlikely event that she had messed me up bigtime (e.g if she commited adultery, got caught and then ran off with the kids or some scenario like that) I'd probably consider doing something mean with it.
